Bill 139 - “Building Better Communities and Conserving Watersheds Act, 2017” - is now in effect. As of April 3, 2018, the Ontario Municipal Board transitioned into the Local Planning Appeal Tribunal.

The LPAT is developing guides on the LPAT process under the Aggregate Resources Act. When it becomes available, this page will be updated. For the moment, you can look up available guides here: http://elto.gov.on.ca/tribunals/lpat/lpat-process/

The OMB has distributed an invitation for a webinar primer on the new Local Planning Appeal Tribunal which members may be interested in attending.  

The webinar is free but you must preregister. Note that it says that the new rules will come into effect on April 3rd. 

At the OSSGA Conference, a presentation was made which included speculation on what the implications of the new system could be, and timelines on transitioning to the new LPAT system.  It is available in the members area of the website.  We will continue to monitor and keep you posted on this issue.

As you may be aware, Bill 139, Building Better Communities and Conserving Watersheds Act, 2017, makes a number of changes to the process of seeking and appealing land use planning approvals throughout Ontario. The Act received Royal Assent on December 12, 2017, and will come into effect on April 3, 2018.

As a result of Bill 139, the Ontario Municipal Board (OMB) is preparing to become the Local Planning Appeal Tribunal (LPAT) upon proclamation.  We are working to develop new approaches to managing Planning Act appeals that are impacted by Bill 139, and are working to streamline case management and hearing room processes to align with the legislated timelines for hearing appeals.  

In preparation for this transition, we are preparing draft Rules of Practice and Procedure for LPAT, which will be posted on our website on March 2, 2018 for your comments and feedback.
